La sentencia que ordena a Chevron pagar para reparar los daños causados durante sus operaciones en la Amazonía ecuatoriana -cuyas desastrosas consecuencias continúan- no tiene ninguna forma de revocarse o apelarse y es deber del Estado ecuatoriano garantizar la seguridad jurídica, el respeto a la Constitución y a las sentencias judiciales, para la implementación adecuada de las decisiones emitidas por el sistema de justicia del Ecuador.

Sin embargo, el laudo arbitral emitido en favor de Chevron y contra Ecuador, bajo las reglas UNCITRAL de Naciones Unidas, es un atentado contra los derechos de los pueblos y sus derechos humanos. Rompe los principios de seguridad jurídica, obstruye el acceso real a la justicia de los pueblos víctimas de crímenes corporativos, destruye la soberanía de los Estados y garantiza impunidad perpetua a las empresas transnacionales (ETN). Pretende que el Estado le pague a la empresa y al mismo tiempo anular las sentencias judiciales ecuatorianas que establecen que Chevron debe reparar a las/os afectadas/os y pagar por el daño ocasionado.

Los tratados de libre comercio (TLC) y de promoción de las inversiones son instrumentos clave del neoliberalismo y otorgan incalculable poder a las ETN. Muchos TLC incluyen cláusulas de resolución de controversias inversionista Estado, que permiten a las ETN presentar demandas contra los Estados ante tribunales arbitrales internacionales si consideran que una política pública o legislación afecta sus ganancias presentes o futuras.  Los tribunales arbitrales constituyen un sistema paralelo a la justicia, los árbitros son elegidos por las partes y muchas veces tienen fuertes vínculos con las transnacionales. Estos árbitros emiten un laudo que es vinculante para aquellos Estados cuyo ordenamiento jurídico reconoce el sistema de arbitraje y/o tienen TLC o Tratados Bilaterales de Inversiones.

El sistema de arbitraje internacional  para la solución de disputas entre inversionistas y Estados (ISDS, por sus siglas en inglés) no es un sistema internacional de justicia, sino del derecho privado comercial y de inversiones, muy cuestionado por privilegiar a las empresas violadoras de derechos humanos y castigar a los pueblos afectados y a los Estados.

Países como Ecuador han decidido en forma democrática y soberana abandonar este sistema del derecho privado y comercial que privilegia los intereses y el lucro de las ETN violadoras de los pueblos y responsables de las crisis socio-ambientales. En Ecuador el sistema de arbitraje internacional es inconstitucional. El pueblo ha ratificado su inconstitucionalidad en un referendo llevado a cabo por el propio gobierno del ultra derechista Daniel Noboa.

En el marco de la Campaña Internacional para enfrentar la impunidad de Chevron, y para conocer más a fondo la situación actual de las/os afectados y los obstáculos que el ISDS impone a la justicia ambiental, realizaremos el Seminario Virtual Internacional ISDS como garantía de impunidad en el caso Chevron – Ecuador, que contará con la participación de:

ISDS as a guarantee of impunity in the Chevron v. Ecuador case

The ruling ordering Chevron to pay compensation for the damage caused during its operations in the Ecuadorian Amazon – the disastrous consequences of which continue to this day – cannot be overturned or appealed, and it is the duty of the Ecuadorian State to guarantee legal certainty and respect for the Constitution and court rulings, so that the decisions issued by Ecuador’s justice system may be properly implemented.

However, the arbitral award issued in favour of Chevron and against Ecuador, under the United Nations UNCITRAL rules, is an attack on the rights of peoples and their human rights. It violates the principles of legal certainty, obstructs genuine access to justice for peoples who are victims of corporate crimes, undermines the sovereignty of states and guarantees perpetual impunity for transnational corporations (TNCs). It seeks to compel the State to pay the company whilst simultaneously overturning the Ecuadorian court rulings which establish that Chevron must compensate those affected and pay for the damage caused.

Free trade agreements (FTAs) and investment promotion agreements are key instruments of neoliberalism and grant incalculable power to TNCs. Many FTAs include investor-state dispute settlement clauses, which allow TNCs to bring claims against states before international arbitration tribunals if they consider that a public policy or legislation affects their present or future profits. Arbitration tribunals constitute a system parallel to the justice system; arbitrators are chosen by the parties and often have strong links to transnational corporations. These arbitrators issue an award that is binding on those states whose legal systems recognise the arbitration system and/or have FTAs or Bilateral Investment Treaties.

The international arbitration system for the settlement of disputes between investors and states (ISDS) is not an international system of justice, but rather one governed by private commercial and investment law; it is widely criticised for favouring companies that violate human rights and for penalising the affected communities and states.

Countries such as Ecuador have decided, through a democratic and sovereign process, to abandon this system of private and commercial law which favours the interests and profits of transnational corporations that violate the rights of communities and are responsible for socio-environmental crises. In Ecuador, the international arbitration system is unconstitutional. The people have confirmed its unconstitutionality in a referendum organised by the government of the far-right Daniel Noboa itself.

As part of the International Campaign to confront Chevron’s impunity, and to gain a deeper understanding of the current situation of those affected and the obstacles that ISDS imposes on environmental justice, we will be holding the International Virtual Seminar: ‘ISDS as a Guarantee of Impunity in the Chevron–Ecuador Case’, which will feature the participation of:
